The Central Committee for the Comprehensive Rule of Law issued an Opinion on Supporting Shenzhen in Building a Pioneering Demonstration City for Socialist Rule of Law with Chinese Characteristics ([2021] No. 7). The opinion proposes to promote the reform of the labor dispute resolution mechanism in Shenzhen, implement the pre-mediation, expand the scope of final arbitration decisions, and explore the establishment of an online integrated "mediation-arbitration-litigation" system. It also calls for arbitration institutions to enhance their physical and standardized operations, and establish a working mechanism for legal aid institutions to actively participate in labor dispute cases in all districts of Shenzhen.
To this end, Beiming Software has proposed a solution, namely, Shenzhen Labor and Personnel Dispute Arbitration Mediation External Service Platform, which will facilitate Shenzhen’s integration of "mediation + arbitration", transform and upgrade the current mediation and arbitration case-handling model, enhance the paperless and intelligent mediation and arbitration, and give priority to digital arbitration tribunals, intelligent arbitration, and online mediation in areas where conditions permit. The platform integrates multi-party information and provides one-stop dispute handling services such as mediation, legal aid, arbitration, and litigation, improving the overall efficiency of labor and personnel dispute-handling, and promoting the diversified resolution of labor disputes.
The Shenzhen Labor and Personnel Dispute Arbitration Mediation External Service Platform consists of an online service platform, a mediation and arbitration system, and an arbitration and case handling system.
1. Online service platform: Provide online mediation and arbitration services and business guidelines for citizens through the WeChat mini program, the official account, and the PC version to bridge the "last mile" of convenient services, and achieve "immediate, online, and nearby handling" of labor dispute mediation and arbitration services, reducing the need for citizens to make multiple trips for on-site applications, repeated information collection, and duplicate registration and handling.
2. Mediation and arbitration system: Use the Internet and other technical means to realize information sharing and online mediation, further optimizing the labor dispute mediation mechanism and process for improved efficiency of mediation. At the same time, the application of digital technology has also improved the operation efficiency of mediation institutions, accurately positioned mediation solutions, and effectively avoided errors and injustices in mediation.
3. Arbitration case handling system: Improve the information coordination between arbitration, litigation, and legal aid, create functions such as online case acceptance, division of cases, online trial, online hearing, online training, and asynchronous trial. It incorporates online authentication, electronic signature, electronic delivery and other technologies to achieve the sharing of case data and documents and the integration of partial business, forming a dispute resolution work model that seamlessly connects mediation, legal aid, arbitration, and litigation.
1."Three Alls": All dispute types covered (new online application functions such as employers suing workers and work-related death cases); all service objects covered (foreigners can log in through the provincial unified user platform and apply for arbitration); all arbitration matters covered (applications, response, cross-examination, hearings, mediation, delivery, withdrawal, etc. can be handled online).
2."Three Multiplicity": multiple operation methods (computer + mobile phone); multiple reminder methods (from "I want to know" to active notifications; automatic sending of text messages throughout the case handling); multiple submission methods (on-site submission, appointment submission, mail delivery, online delivery, etc.).

After the completion of the Shenzhen Labor and Personnel Dispute Arbitration and Mediation Platform project, a one-stop service mechanism for "mediation, legal aid, arbitration, and litigation" was established to promote cross-departmental data sharing, online connection and collaborative processing. The overall efficiency of labor dispute resolution increased by 70%, and about 268 new paperless arbitration and mediation documents were added, which is expected to save 250,000 document printing costs per year; electronic delivery coverage reached 100%, which is expected to save hundreds of thousands of mail delivery costs per year. Through the online application of the labor and personnel mediation dispute platform, the overall handling efficiency has increased by 60%, and the number of visits to the offline case handling hall has been reduced by 5,000 within six months.
