On May 16, the Achievement Conference of the 2024 Blue Book of Rule of Law: Annual Report of Informatization of Chinese Courts was held in Beijing. During the event, China’s first "Proof of Foreign Law" platform developed by Beiming Software Co., Ltd. (hereinafter referred to as Beiming Software) was unveiled as a information construction achievement of the Guangzhou Intermediate People's Court (GIPC), which attracted great attention from the industry.
The "Proof of Foreign Law" platform has two major legal databases: cases of Proof of Foreign Law and foreign-related laws and regulations. It integrates such three major functions as case retrieval, legal retrieval, and statistical analysis, and links with authoritative identification agencies to introduce rules and operating guidelines for Proof of Foreign Law, thus achieving a "one-stop" low-cost and efficient way of proof of foreign law. The platform, highly affirmed by the Supreme People's Court of the PRC in 2022, was selected as an excellent reform project of the Guangdong Provincial Court to "seize demonstration, promote reform and benefit people's livelihood". In 2023, it was listed in the "Typical Cases of Guangdong Province Accelerating the Connection of the Rules of the Guangdong-Hong Kong-Macao Greater Bay Area".
In recent years, cross-border civil and commercial exchanges have become more frequent, and the application of foreign law in foreign-related trials has become much more frequent. However, foreign law has become a "bottleneck" that restricts the quality and effectiveness of foreign-related trials and affects the credibility of foreign-related judiciaries, due to problems such as "limited methods to ascertain, cumbersome procedures, excessive costs, long cycles, and difficult review and determination". In order to solve the problem, the Guangzhou Intermediate People's Court commissioned Beiming Software to develop a "Proof of Foreign Law” platform.
The "Proof of Foreign Law" platform uses artificial intelligence technology to professionally sort out the effective cases of extraterritorial law applied by more than 50 courts across the country to achieve multi-dimensional and advanced retrieval of cases; through machine learning algorithms, the case database is linked with the legal library to create three-dimensional Proof of Foreign Law use scenarios, and provides multiple extraterritorial legal resource database links, one-click directly to the Proof of Foreign Law Center of the International Commercial Court of the Supreme Court to achieve intelligent retrieval of foreign laws and regulations. In addition, the platform uses systematic data algorithms to generate visual reports based on statistical analysis results such as case types, parties' subject conditions, and the application of foreign laws, which meets the advanced needs of users such as research and decision-making.
Since its launch on March 29, 2022, the "Proof of Foreign Law" platform has received more than 260,000 visits to the webpage, collected more than 48,000 foreign laws and regulations, collected 376 cases of Proof of Foreign Law, and nearly 70,000 foreign-related judgment documents. Eight legal and regulatory resource banks and five Proof of Foreign Law institutions have been linked.
